Not my area of expertise. Perhaps Ben Balter should weigh in? MIT will conflict with CC such that the more permissive license would hold. Software an non-software content are both intellectual property. Both are protected by copyright law. Both are licensable. I would think the more permissive would hold should a subsequent lawsuit occur.

There's a principle that someone cannot benefit from confusion in contract terms they themselves author.
