Not my area of expertise. Perhaps Ben Balter should weigh in? MIT will conflict with CC such that the more permissive license would hold. Software an non-software content are both intellectual property. Both are protected by copyright law. Both are licensable. I would think the more permissive would hold should a subsequent lawsuit occur.
There's a principle that someone cannot benefit from confusion in contract terms they themselves author. A license is essentially a contract that says, "in consideration of your complying with my terms, I grant you license to use my IP. This shows they have chosen to support both software and content. They should continue to support the content owners by offering licenses commensurate with need.
Further, Github has sufficient data resources to determine the ratio of software to non-software on their system.
